Q: Voting Rights - What are my voting rights in the Condominium Association?
A: The owner or owners of each condominium unit in Breakwater are entitled to one (1) vote on any matter requiring a vote by the unit owners. Voting rights and procedures are described in further detail in the Governing Documents.
Q: Leasing - What restrictions exist in the condominium documents on the leasing of my unit?
A: A unit may be used only for residential purposes. The restrictions on residential use are found in the Declaration of Condominium. Rentals are for a minimum of 30 days and a maximum of three times per year.
Q: Assessments - How much are my assessments to the association for my unit type and when are they due?
A: Regular assessments are based on the Association’s annual budget and unit type. They are due quarterly on the first day of January, April, July and October. Please see Owner>Financial Reports on the Breakwater website for budget and assessment breakdown.
Q: Pelican Bay Foundation (PBF) - What is the nature of membership in the Pelican Bay Foundation? What are my voting rights in this association, and how much are my assessments for PBF?
A: All unit owners are Class A members of the Pelican Bay Foundation because of ownership of a unit in the Breakwater Association. Each Class A member of the Foundation has one vote for each property unit owned. For information and assessment information, please call Pelican Bay at (239)597-8081. The assessment levied is included in the first quarter Sanctuary statement of maintenance that is sent to each unit owner payable on January 1st of each year.
Q: Power Outage - Who do I contact?
A: When you experience a power outage you can always call FPL at (800) 375-2434 and provide them with your address. They will an estimated time for power restoration and the reason for the outage.
Q: Power Outage - What happens with the Gates?
A: Our front gate has a battery backup system and will open under battery power. It closes on its own when power is restored. The backup batteries will then recharge themselves. We do not have backup generators for the elevators. Please know if you need to get out of the building in an emergency and you are unable to use the stairs, you can always call 911.
