Attic Hatch Access (for Second Floor Owners)
Please be aware that there are fire suppression system lines (also known as sprinkler lines) located in the attic space of all 2nd floor units.    

There have been several instances when vendors have inadvertently stepped on a pressurized fire suppression line and flooded the 2nd floor unit  If not caught early, this flooding can affect the adjacent 2nd and 1st floor units, thus affecting the entire quadrant of a building.  

Please ensure anytime you have vendors working in your unit, you ask if they will need attic access.  This is particularly true for any remodels/renovations that you have planned.   This can be for running surround sound, lighting, A/C related repairs and other issues, which you might not think would require attic entry.  Even trained professionals have inadvertently stepped on these lines.   
 
Vendors carry varying levels of insurance which may not be sufficient to make the unit owner whole therefore, the unit owner(s) homeowners' insurance policy (H06) may be needed.  Please be sure your HO6 policy is up to date with the proper levels of coverage.  
 
Email reminders will be sent regularly by the Association to all owners to be diligent to keep this unfortunate event from happening.  
 
There is also an attic hatch sticker that must be placed on the attic hatch itself.  Stickers are available in the manager's office.

 
Bicycles
Bicycles should be stored in your garage (or unit) when you are not here. This allows others to use the bicycle racks, and bicycles should be removed as hurricane preparation. Bicycles shall not be parked on sidewalks but should be parked in one of the bicycle racks or in your garage.

 
Board of Director (BOD) Meetings
Board meeting are typically held the second Thursday of each month at 10:00 a.m. Eastern.  See Board of Director Meeting Agenda. Owners are welcome and encouraged to attend. During COVID-19, and typically during off-season, meetings are online. You will get an email with directions to attend.

 
Clubhouse Use and Reservation for a Private Party
General rules for Clubhouse use are:
  • No smoking
  • No wet bathing suits or wet feet allowed
  • No pets are to be in the clubhouse at any time
  • No children under 12 without an adult
  • Diaper change in restrooms only
  • No roller blades or skates
  • No excessive noise
  • Immediate clean up of spills required
Members may use the Clubhouse for private functions.  To do so, they must follow the "Provisions for use of Breakwater Commons Clubhouse by Unit Owners" policy which is available in the office in the Clubhouse.   Members are required to pay a $200.00 deposit at the time of making the reservation.  If the clubhouse is returned to its original condition, the deposit will be returned.  To initiate a request for reservation, click here.

 
Condo Leasing
Lease applications are required on all seasonal and annual leases.  Lease and Sales application forms are available in the Owner/ Documents & Forms tab on the Breakwater website or by clicking here: Lease Application Packet.  Complete and submit Lease Application to Southwest Property Management.
 
A $150.00 fee is required at the time of application.  Background screening is required for each person 18 years of age and older. Guests of tenants that will stay (30) days or longer will also require background screening if they are 18 years of age and older. There is no additional fee for the background check. Annual leases that renew from year to year with no break in the lease date are exempt from the $150.00 application fee.  This does not include the fees required by the Pelican Bay Foundation for leases and sales.  Lease terms must be for at least (30) days and a unit cannot be leased more than three times per calendar year. 

 
Condo Remodeling
As a new owner, you may have some exciting ideas on how to improve your home. Please be aware that the Association has an architectural review process for changes to your home that must be approved prior to any modifications. Renovations are permitted only with approval and during the months of (May 1st through November 1st - NO EXCEPTIONS).
 
The Request for Modification form is listed on the website under Owners / Documents & Forms, or you can go to the document here: Request for Modification. The purpose of this process is to preserve, enhance and protect the property values and assets of the community as well as to ensure compliance with all Breakwater covenants.  The Application may also be obtained from Veronica Lee. Completed applications must be forwarded to Veronica Lee, Property Manager.  Board of Director (BOD) approval is required after submitting the Architectural Change application.
 
Important: If you intend to drill into or open any interior wall, you or your contractor must file for a permit from Collier County.  The permit must be displayed on your door and construction must be done only between (9 AM and 5 PM) Monday through Friday. Contractors are now also permitted to work on Saturdays 9AM to 5PM which adds twenty-six more working days to the renovation period.  Contractors are to haul away all debris and not leave large items or renovation materials behind.  Debris is not to be place in Breakwater dumpsters. Contractors are also not permitted to park in the garage tunnels.  Owners are to remind their contractor of same.

 
Guests
If you have guests while you are not in residence you must complete a guest application found at www.breakwaterpelicanbay.com / Forms.  You are responsible for reviewing the Rules & Regulations and Garbage & Recycle Rules with your guest.

Home Watch
A home-watch service can detect a problem before it has a chance to become a catastrophe, and some insurance policies actually require unit owners to hire a home watch service when they will be away.  The Association encourages those of you who do not have a home watch service to procure a professional. 
 
A professional home-watch service knows what to look for when inspecting your home for defects.  The most common issue is water leaking from ice makers, dishwashers; washing machines, water heaters, plumbing fixtures or the air conditioner condensate drain line backing up into the unit if it has not been serviced every six months.  A home-watch service in combination with turning the water off to your unit is strongly recommended when away for longer than (48) hours.

 
Hurricane Shutters
Hurricane Protection: Shutters must meet Standard of South Florida Building Codes and Breakwater Association specifications: operate vertically, all white in color.  Shutters may be installed by unit owners only with prior written approval of the BOD, using the Request for Modification application.  All open exterior areas of a unit, including screened lanais, must be completely clear of furniture and decorative items in unoccupied units during hurricane season.

 
Landscaping 
Trees, plants, and shrubs may not be planted, pruned or altered without prior approval of the Landscape Committee. Submit requests via Landscaping Permission Form.

 
Pests (Insects/Critters) In or Around Condo
Call Purcor directly at (239)-790-6995.  Additional information is found at Breakwater Pest Control. Rodents, animals and other wild life, please contact the Breakwater office at (239) 566-6088 and a trapper will be contacted.

 
Pets
The owner(s) of each unit may keep a reasonable number of pets.  Renters may not keep pets with the exception of (12)month annual renters.   
 
Pets must be on a leash at all times while on the community property outside. Pet owners shall immediately remove any animal droppings left by the owner's pet upon the common elements.
 

 
Pool
The pool area is for owners, guests, and renters.  Pool hours are dawn to dusk.  Please be aware of pool rules that are posted at the pool site.  Please be considerate of fellow residents by leaving the area in a clean and organized condition when you leave.  Chairs should be returned to a position along the perimeter fence/wall, and umbrellas should be down.

Social Events
Social events are coordinated by the Breakwater Social Committee.  See Social Committee for a list of committee members and a schedule of events.  Event notification is typically done via broadcast email and posting on this website.

 
TV and Internet Services
Pelican Bay has officially transitioned from Summit Broadband to Hotwire Communications for TV and internet services. All associated charges remain included in your association’s quarterly fees.

Hotwire Installation & Support
Installations are currently available for all properties and can be scheduled at your convenience. The deadline for installation appointments is January 31, 2025.

Vehicles and Parking 
Please be mindful of the speed limit (15 mph) and come to a complete stop at stop signs.  Pedestrians and bicycles have the right of way.  Be courteous and safe at all times.
 
Owner vehicles should be kept in garages.  Parking on streets or sidewalks is prohibited. Unit owners’ vehicles shall be parked off premises when their unit is occupied by a renter. Parking of trucks, pick-up trucks, campers, motor homes, commercial vehicles, motorcycles, boats, trailers, golf carts and certain other vehicles is prohibited or limited to temporary parking as provided therein. Car covers are not permitted in public areas. Owners and renters are limited to parking two (2) vehicles on the premises. Installations for electric vehicles must comply with the rules regarding electric vehicle charging. 
 
Car Wash area - A hose is set up at the north end of the clubhouse (outside of the maintenance garage) for car washes. 

 
Website Use
Your are in the Breakwater website, www.breakwaterpelicanbay.com.  The website is a vital source of information for owners. At the top in the navigation bar under our Association name, you will see multiple topics/tabs. There is a lot of information available to owners, guests, renters, prospective buyers, and realtors under these tabs. Information restricted to owners will require you to Login using the username and password you were emailed once your purchase closed.
 
Acceptable Use Policy - By logging in, you are giving your consent to following the Acceptable Use guidelines for this website and associated social platforms.  This means that you understand that any and all comments and content on the site are intend to be respectful, and that the following are prohibited:
  •  Harassing, discriminatory, or otherwise threatening comments and material
  •  Obscene, pornographic, hateful, incendiary, violent, unlawful, or otherwise illegal comments and material
  •  Copyrighted material and images
  •  Defamatory comments
  •  Personal views, posted as representative of the association
  •  "Junk" messages, advertisements, or other solicitations not related to the association
 
Content on the site is monitored, and abuse of the Acceptable Use guidelines may result in loss of access to use of the website beyond what is available to the public.

 
Work Order Request
A Work Order Request is used to identify maintenance that the association is responsible for.  There are several different types of requests. See the Owner tab and Work Order Request in the dropdown menu.
  • Infrastructure Work Order Request : Complete when identifying infrastructure in need of repairs, maintenance, or improvements in areas that you notice on common property.  
  • Landscaping Work Order Request: Complete when identifying landscaping issues or requests. 
  • If completed online, a Work Order Request (or Landscape Request) will be delivered electronically to Veronica Lee, our Property Manager at Southwest Property Management.
  • Alternatively, you will find a PDF version of the Landscape Request form on the website under the Owner tab and Documents & Forms in the dropdown menu.  You may print, and fill out the forms, then deliver to the Property Management office.  If you prefer paper forms, you may also pick up Work Order and Landscape Request forms at the Property Management office.

 
GARBAGE & RECYCLE RULES
 
Trash is collected (1) time per week (May 1st through Oct 31).  Waste Management collects trash from all eight (8) dumpsters on Tuesdays.
 
Trash is collected (2) time per week (Nov 1st through April 30th). Waste Management collects trash from all eight (8) dumpsters on Tuesdays and Fridays. 
 
Recycling is collected on Fridays, year round.
 
Garbage
Whenever possible, trash should be bagged.  All boxes must be broken down before being place in the dumpsters.  No liquids (paint, cleaning fluids, etc.) are to be placed in the dumpster.  It is the owner's responsibility to ensure all construction debris and packing materials are taken off-site by the contractor or mover.  Construction materials may not be placed in dumpsters.
 
Each resident must place garbage in the garbage corral closest to his/her building. That area must be kept clean by each resident. Nothing is to be left on the ground near garbage cans. 
 
If the dumpster nearest you is full, take your trash to another dumpster.  There are eight (8) dumpsters in the complex and they do not all serve the same number of units.  Under no circumstances is trash to be left beside the dumpster.

Recycling
Breakwater has recycling cans inside each garbage corral.  Look for green cans with yellow tops. 
 
Recycling centers will not accept recycled items disposed of in plastic bags.  Empty your loose recyclable items from a plastic bag directly into the can and then dispose of the plastic bag in the dumpster.  Publix, Walmart and Kohl’s have recycling bins for clean and dry plastic bags.
 
All items must fit inside the large recycling carts. Break down cardboard boxes to fit inside the cart.  Leave NOTHING on the ground or on top of the cart.

Pharmaceuticals 
How to get rid of unwanted residential pharmaceuticals:
Do not throw unwanted residential pharmaceuticals into toilets or storm drains.  It is a danger to our environment.
Do not place residential syringes and needles into your garbage and recycling carts as they can pollute the water supply or fall into the wrong hands
•  Do lock up all medications and keep away from children and teens
 
For proper disposal of unused or expired prescriptions including controlled substances and over-the-counter medications. Dump medications from container into Ziploc bag and take to:

Take to recycling center or see www.colliercountyfl.gov for locations to donate cell phone.
 
Recycling or donating cell phones helps the environment by saving energy and keeping usable materials out of landfills.  Cell phones are made of precious metals, copper, and plastic - all of which require energy to mine and manufacture.
 
Preparing Cell Phones for Recycling or Donation
Terminate your service. 
Clear the phone's memory of stored information.
Remove your Sim card, if there is one.
